Our Commitment to Privacy

North Texas Tollway Authority (“NTTA”) respects the privacy of our customers and website visitors. This Privacy Policy applies to personal information provided or obtained through our websites, including ntta.org, drivingnorthtexas.com, tollperks.com, specialtytolltags.com, mytolltag.com, progressntta.org, and our TollMate application (collectively, “Sites”), as well as any personal information received by NTTA on the official NTTA page on Facebook and any other NTTA-authorized social media page or application (collectively, “Social Media Pages”).

Please note that information or other content submitted on any third-party website or application linked to the Sites or on a Social Media Page is subject to the terms and privacy policy of the third-party website or application, and not the terms of this Privacy Policy.

Information We Collect

Contact Information. When you contact us using one of our online contact forms, register to receive news or updates, or send us any communication through the contact methods provided on the Sites, we receive the messages you send as well as the personal information you provide, such as your name, phone number, and email address.

Account and Toll Transaction Information. We generate and collect transaction details in connection with TollTag accounts, ZipCash payments, or other toll-related accounts and payments. This may include toll assessment and historical travel-related data associated with your account or a vehicle for which you are responsible, as well as payment card data, your name, phone number, billing address, email address, and any other information that you provide or that is generated from information you provide for account maintenance or payment processing purposes. In addition, if you have a TollTag or other account with us, you will be required to create a username and password. Note that it is your responsibility to secure and maintain the confidentiality of your username and password and that you may be responsible for any or all account activity using your username and password.

User-Posted Content. Some of the Sites may offer a user forum or other functionality that permits the posting of content by users. You should assume that any content you post will be public and will be publicly associated with your name or account username. We will likewise treat any such posts (and the association of the post with your name or account username) as public absent a clear statement to the contrary on the Site page(s) from which the post was made.

Log Data. We automatically gather Site usage data for analysis and security purposes, and we may use service providers to assist us in doing so. This may include collection and use of your IP address or other browser or device identifiers.

Cookies and Similar Technology. A “cookie” is a small data file that is transferred to your browser or mobile device through the Site. Our Sites may use cookies and similar technology in order to study, enhance, and improve the use and capabilities of our Sites. The technology may be used to collect or use information concerning your IP address or other browser or device identifiers. We also use cookies or similar technology to enable certain features of our Sites, and to preserve your preferences and customize your experience when you visit and return to the Sites. Most browsers provide controls whereby you can choose to block receipt of cookies, to delete cookies, or to be prompted before cookies are received. Please note that if you delete or choose not to receive cookies from any of our Sites, the functionality of the Site may be impaired.

Third Party Data Collection/Online Tracking. When you visit the Sites or open our emails, our third-party partners, such as social media widget providers, analytics services, and email services, may collect certain information by automated means, such as cookies, web beacons, and web server logs. Our partners use this information to provide their services to us and to help us understand and improve the functionality and usage of Sites and our email communications to you. The providers of these services may also use your IP address or an anonymous identifier as well as certain information from your browser, together with other non-personal information about your visits to our Sites and other non-affiliated websites over time, for the purposes described in their privacy policies. In addition, we may work with an email service provider, such as Constant Contact, to facilitate email communications from us, to send email communications, and to help us analyze the success of our email communications. Our email service provider may collect and submit to us registration information you submit on newsletter registration forms for our use. Like many other websites, we use Google Analytics and similar website analytics tracking software. Traffic and usage data collected by Google (obtained through the use of Google cookies on the Site) is subject to Google’s privacy policy. Per the applicable Google Analytics service terms, Google does not collect personally identifiable information in connection with those services. Note that Google offers a Google Analytics browser add-on (designed to be compatible only with certain browsers) to provide website visitors the ability to prevent their data from being collected and used by Google Analytics. Some Internet browsers offer a “do not track” or “DNT” option that uses a DNT header to indicate the DNT preference setting on the browser. NTTA does not track your activity over time and across different websites or online services except as among NTTA’s Sites and as otherwise described herein, and we do not currently respond to browsers’ DNT signals with respect to the Sites. We do not permit our third-party service providers to collect information from the Site for other websites or for their own purposes other than as described in the preceding paragraph.

Job Application Information. We may collect names, addresses, phone numbers, job history, references, and other information you submit if you use the Sites to apply for employment with NTTA. Such information is used for purposes of evaluating your application (which may include contact with third parties), and to contact you in connection with that application. Your application and related information may be entered using an online form provided to us by a third party. Please be sure to review the disclosures in the online application process regarding the collection and use of information for employment background check purposes.

Social Media

Actions you take using social media may be reflected in a manner visible to others. For example, if you “Like” us on Facebook or follow us on Twitter, Instagram, or YouTube, others may be able to see that you have done so.

The collection and use of information on social media websites and applications is governed by the separate privacy policies of those websites and applications. Please remember that, as a general rule, any content or information posted on the NTTA page on Facebook or on social media pages or channels such as Twitter, Instagram, or YouTube is public. In addition, please note that, to the extent permissible under the applicable policies of the social media site, we may re-publish posts from a Social Media Page on one or more of our Sites.

We may receive personal information from a social media site platform or application when you connect through a social media feed, post content, or otherwise interact with us using social media tools. For example, we may receive basic Facebook account information (name, email address, gender, birthday, current city, and profile picture URL) through the NTTA page on Facebook. Also, when you “like,” “subscribe to,” or send a “tweet” to us through a social media channel, we may receive your username, handle, and any other available personal information from the social media site or application. All non-public information received from social media sites and applications is treated and used in the same manner and for the same purposes as described in this Policy with respect to similar information we obtain through the Sites.

Vendor and Service Provider Information. In addition to information about our customers and individual visitors to the Sites, we may collect information from prospective or actual service providers and vendors using the Sites. This information may include contact information, information about prospective offerings, and other information needed to evaluate prospective offerings. We may use this information to evaluate proposals and offerings and in any other manner permitted or required by law.

Data Collected in Connection with the TollPerks Program. As part of the TollPerks customer rewards program, NTTA collects, uses, and provides information to the third-party program administrator for the purpose of administering the program. This information includes personal data such as a program participant’s name, TollTag account number, and transaction data (toll locations, dates, times and/or amounts, but not including any payment card data).

Data Collected in Connection with Sweepstakes. In connection with sponsoring sweepstakes, NTTA collects and uses personal information, including names, addresses, email addresses, phone numbers, and birth dates obtained from or provided by sweepstakes entrants. This information is provided to the third-party program administrator for the purpose of administering the sweepstakes. If NTTA co-sponsors a sweepstakes with another entity, you may be providing sweepstakes-related information to NTTA’s co-sponsor as well as to NTTA, and you should be sure to review that co-sponsor’s privacy policy to learn about the co-sponsor’s privacy practices with respect to your personal information.

How We Use, Share, and Protect Personal Information

We may use personal information for the purpose for which it was provided, as well as in any manner consistent with this Privacy Policy. We may share personal information with service providers and third parties as set forth above (including for analytics and security purposes) and to assist us in providing services, processing transactions, collecting unpaid debts, and operating the Sites. We may also share toll-related information (e.g., travel data associated with a license plate number or TollTag account) with other tolling authorities and law enforcement in order to process transactions, seek remedies for toll violations, improve safety, and otherwise to the extent permissible by law.

We may use personal information as well as other data for research purposes, and to improve the Sites and our other services. In addition, we may use some of the information that we collect concerning you in order to present you with information concerning services or other offerings and information that may be of interest to you. We may retain and use communications, transaction details, your IP address, and other information in order to maintain audit trails for security purposes.

We are committed to maintaining the security of personal information. We employ reasonable security measures to secure and protect the information we receive. As a general rule, we require that our service providers use personal information only for the purpose for which it is provided. Please note, though, that with respect to information (such as name and email address) that you submit using an online newsletter registration form provided by Constant Contact or another email service provider, we may permit the service provider to use that information for other purposes, subject to the email service provider’s privacy policy (Constant Contact’s privacy policy can be found here). We also require assurances that our service providers will appropriately protect personal information entrusted to them.

Disclosure of Personal Information

In addition to the sharing of personal information as discussed above, we disclose personal information as necessary for our business operations, such as in connection with providing assistance to you or processing your transactions. We may also disclose information concerning you if required to do so by law (which, in some circumstances, may include responding to requests made pursuant to the Texas Public Information Act) or if we believe that such action is necessary to comply with a legal obligation, to enhance public safety, or to protect and defend our rights or property, or the rights or property of others. We may publicly disclose information you share with us concerning our services, traffic, or road conditions.

Review and Correct Information You Submitted to Us through Online Forms

You may request to review and correct the information that you have submitted through online forms available on the Sites and that we retain. We may ask you for additional information to help us provide you with the requested information and before we make any changes to it. To submit your request, please contact privacy@ntta.org.

No Use by Individual Under the Age of 18

Individuals under the age of 18 are not permitted to use the Sites. We do not knowingly collect or solicit personal information from children under the age of 18 or knowingly allow such persons to register for an online account or provide personal information through the Sites. If we learn that someone under the age of 18 has provided personal information through the Sites, we will make every reasonable effort to promptly delete that information.

If you are a parent or guardian who believes that your minor under the age of 18 has submitted personal information to us, please contact privacy@ntta.org. Once we verify that you are the parent or legal guardian, we will cooperate with you to discuss what, if any, personal information we have collected through the Sites about your minor and to what extent that information may have been shared or disclosed, after which we will work to delete that information.

Notification of Changes to Policy

We reserve the right to modify this Privacy Policy. Whenever we decide to change this Policy in any material manner, notice of the change will be posted on the Sites for a reasonable period of time. Nevertheless, you should review the Privacy Policy from time to time to be sure you are aware of the most recent version. We will use personal information in accordance with the Privacy Policy in effect at the time the information was collected.
